01 Acceptance

By accessing or using Lumex, you agree to these terms. If you do not agree, please do not use the service. These terms are an electronic record under the Information Technology Act, 2000 and do not require a physical signature.

02 About Lumex

Lumex is operated by Webority Technologies Private Limited (CIN: U72900HR2019PTC079747) (registered in Gurugram, India). It is a software platform for IEC 62305 lightning risk assessment.

Lumex is a tool, not an assessment. It does not perform the assessment for you, and it does not replace the qualified engineer who carries it out and signs the report. Final responsibility for the assessment and the protection design rests with that engineer.

03 Eligibility: business use only

Lumex is sold to businesses, not to consumers. You may open an account only in the course of a trade, business, craft or profession, and you confirm you are doing so. At checkout we ask for a business tax-registration number, or a declaration that you are buying for business purposes, and we may decline or close an account opened outside that basis.

You must be at least 18 years old and authorised to act for the firm or organisation you register. You confirm that the information you provide is true, accurate and your own to share.

Because Lumex is not sold to consumers, consumer-specific rights such as the statutory cancellation or cooling-off period do not apply to your purchase. Cancellation and refunds are governed by our Cancellation & Refund Policy.

04 Accounts & workspaces

You sign in with your email and password. Keep your access secure and report any unauthorised use to privacy@lumex.zone. A workspace is shared by your team; the Admin manages roles and billing, and you are responsible for the actions of users you invite.

05 Plans, credits & fees

Lumex is a paid service. Each workspace includes a monthly free allowance, and you can add subscriptions or credit packs for additional branded reports and inspections. Generating a final report or inspection consumes a credit; drafting and recomputing are free. Fees are shown before purchase, exclusive of taxes unless stated, and we may change prices with reasonable notice.

06 Payments, renewals & refunds

Payments are processed through our payment provider (Razorpay) and billed in US dollars. Prices are shown exclusive of tax. Where local tax law requires it, tax is calculated and added at checkout from your billing address, and every invoice is itemised: GST in India, VAT in Europe and the United Kingdom, GST in Australia, and the equivalent elsewhere. Where you supply a valid business tax-registration number and the reverse charge applies in your country, we invoice without tax and you account for it yourself. Subscriptions are month-to-month with no lock-in and renew automatically until cancelled; you can cancel anytime and keep access until the end of the paid period. Purchased credit-pack balances do not expire. Except where the law requires otherwise, fees and used credits are non-refundable.

07 How the engine works

Lumex runs the IEC 62305-2:2024 risk-management method deterministically from the inputs you provide. You are responsible for the accuracy of your inputs and for reviewing every result. We do not guarantee that an assessment will pass, satisfy any authority, or be free of error, and Lumex does not itself certify compliance.

IEC 62305-2 clause 7.3 NOTE 1 gives a tolerable risk of 1×10^-5 per year as a representative value. The standard permits a different value after detailed investigation, and national or local regulation may fix the tolerable risk, the tolerable frequency of damage and the Annex A, B, C and E rules and parameter values. You are responsible for selecting the jurisdiction that applies to the structure you are assessing, and for confirming that the values Lumex applied are the ones your authority requires.

08 Competent review is a condition of use

Lumex output is not a certification and must not be issued as one. You may not issue, submit, publish or otherwise rely on a Lumex assessment or report until a competent person, qualified in the jurisdiction where the structure is located, has reviewed the inputs and the result and signed it. Lumex is a calculation and documentation tool; the professional judgement, the design decisions and the signature remain yours. Using an unreviewed Lumex output as though it were a completed professional assessment is a breach of these terms.

09 Your content & data

You keep ownership of the data you upload and the reports you generate. You grant us a limited licence to host and process that content solely to provide the service. You confirm you have the right to upload the documents and information you put into Lumex.

Where you upload personal data about your own clients, you are the controller and we are your processor. The data-processing terms in our Privacy Policy apply to that processing and form part of these terms: the purposes and duration of processing, the categories of data and data subjects, our obligation to act only on your documented instructions, confidentiality, the security measures, the sub-processor list and the 30-day change notice, our assistance with data-subject requests, breach notification without undue delay, and deletion or return on termination. No separate signature is required, though we will sign a standalone Data Processing Agreement on request.

10 Acceptable use

You agree not to use Lumex for any unlawful purpose, not to misrepresent yourself or your authority, not to upload malware, and not to reverse-engineer, scrape, overload or disrupt the service. You may not resell or sublicense access without our written permission.

11 Intellectual property

The Lumex platform, software, design and content belong to Webority Technologies Private Limited and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service while your account is active. Your firm's branding and your assessment content remain yours.

12 Disclaimers

The service is provided "as is" and "as available". Lumex supports lightning risk assessment; it does not provide engineering, legal, financial or other professional advice, and it does not replace the published standard or the professional judgement of a qualified engineer.

13 Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is limited to the total fees you paid us for Lumex in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental or consequential losses.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot lawfully be excluded or limited. Where a mandatory law in your country gives you rights that these terms cannot reduce, those rights are unaffected.

Lumex is a calculation and documentation tool, and the limit above is set against that role. It does not carry professional indemnity for the engineering judgement in an assessment: the assessment is yours, signed by your competent person under section 08, and any professional indemnity cover for it is yours to hold.

14 Indemnification

You agree to indemnify and hold Webority Technologies harmless against third-party claims, losses and costs arising from your breach of these terms, your misuse of the service, or the content you upload.

15 Suspension & termination

Either party may terminate at any time. We may suspend or terminate access if you breach these terms or to protect the service or other users. On termination you can export your data for a reasonable period, after which it is deleted in line with our Privacy Policy. Clauses that by their nature should survive termination will continue to apply.

16 Governing law & disputes

These terms are governed by the laws of India. Any dispute will be resolved by arbitration seated in Gurugram, Haryana under the Arbitration and Conciliation Act, 1996, and the courts at Gurugram will have exclusive jurisdiction over matters not subject to arbitration.

Lumex is sold to businesses only (section 03), so this clause is a commercial choice of forum between businesses. Where a mandatory law in your country gives you a right to bring proceedings in your own courts, or applies its own consumer or contract protections regardless of this clause, that law prevails and nothing here is intended to displace it.

17 Changes to these terms

We may update these terms from time to time. We give at least 30 days' notice by email before any material change takes effect. Continuing to use Lumex after that date means you accept the updated terms.

If you do not accept a material change, you may terminate before it takes effect and we will refund the unused portion of any period you have already paid for. A change is material if it reduces the service, increases the price, or shifts risk to you.
